Variances

If certain requirements of the Zoning Ordinance do not allow the property owner reasonable use of the land or buildings due to special circumstances or conditions which are peculiar to the land or building, then the property owner may apply for a “variance”.

All requests for a variance must include a completed application with original signature of the property owner, proof of ownership and a non-refundable application fee.

All applications must be submitted at least 45 days prior to the Board of Zoning Appeals meeting. All property owners within 200 feet must be notified by certified mail and invited to the hearing at which it will be considered. The property owner will be responsible for posting a public notice sign on the site 15 days prior to the hearing. The Town will provide the public notice sign, but the property owner will be responsible for paying the costs of the sign. The property owner will also be responsible for covering the costs of the certified letters sent out to applicable surrounding property owners, along with the costs for the advertisement in the newspaper.

The Board of Zoning Appeals will conduct a hearing prior to approving or denying the request for a variance.
